Code of honor of civil servants of the Republic of Kazakhstan
(Rules of ethics of civil servants)
1. General regulations
1. To be a public service is an expression of special confidence of the society and the state and places high demands on the moral and ethical standards of public servants.
The society expects that the public servant would put all his strength, knowledge and experience in their professional activities carried out impartially and honestly serve their country - the Republic of Kazakhstan.
2. This Code of honor of civil servants of the Republic of Kazakhstan (The rules of ethics of public servants) (hereinafter - the Code) in accordance with the Republic of Kazakhstan dated 23 July 1999 "About Public Service", the Law of the Republic of Kazakhstan dated July 2, 1998 "About Anticorruption driving " and generally accepted moral and ethical standards set basic standards of conduct for public servants of the Republic of Kazakhstan.
3. Heads of the state bodies in the central executive bodies are executive secretaries of central executive bodies or officials, who have authority of the executive secretaries of the central executive bodies. Heads of central executive bodies are providing fulfillment of the requirements of this Code, a placement of this Code’s in state agencies in areas accessible to the general public in the absence of executive secretaries of the central executive bodies or the officials.
4. Public servant must study this Code in writing form for a month after the civil service.
2. General rules of conduct for public servants
5. Public employees must:
1) be committed to the policy of the President of the Republic of Kazakhstan and consistently implement it, the actions to strengthen the authority of the government, to prevent the commission of acts which may discredit the institutions of the state;
2) follow the principle of the rule of law, the Constitution, laws and other normative legal acts of the Republic of Kazakhstan;
3) work for the well - being of society and the state;
4) counter some acts detrimental to the interests of the state, preventing the efficient functioning of the public authorities;
5) take care of the public property, to use it efficiently and effectively;
6) ensure respect and protection of the rights, freedom and legitimate interests of individuals and legal entities, to prevent manifestations of bureaucracy and red tape in the consideration of their appeals in time to take necessary action on the appeals;
7) keep and strengthen public confidence in the civil service and state institutions;
8) not give a rise to legitimate criticism from the community by own actions, prevent persecution for criticism, use constructive criticism to correct deficiencies and improve his activity;
9) be honest, fair, modest and polite, comply with generally accepted moral and ethical standards;
10) strengthen the unity of the people of Kazakhstan and ethnic harmony in the country and respect the state and other languages, traditions and customs of the people of Kazakhstan
11) to comply strictly with state and labor discipline, lead legislative authority effectively, execute his or her duties faithfully, impartially and efficiently; use working time rational;
12) make the necessary efforts to highly professional work; apply the best and economical effective solution to any problem;
13) resist actions that hinder the proper execution of public servants’ duties;
14) avoid cases of recruitment and placement on the grounds of kinship, communities and personal devotion;
15) determine the objectives and scope of official authority subordinate employees accurately, not give unrealistic orders, not require the execution of subordinate employees’ assignments outside their official duties;
16) not allow unfounded allegations, facts, and rudeness, humiliation of human dignity and tact for the subordinated employees;
17) not enforce subordinate employees to commit illegal acts or misconduct incompatible with accepted ethical standards;
18) have the necessary level of training, including on the execution of which referred to the functional responsibilities of subordinate employees;
19) prevent and suppress violations of professional ethics on the part of other public officials;
20) adhere to the business style of dress during the execution of their duties.
6. Public servants must observe business etiquette; respect the rules of official conduct.
7. Public employees should not use their position and related opportunities in the interest of public and religious associations, other nonprofit organizations, including the promotion of his/her relationship to them.
Government employees in a supervisory role cannot compel to participate in civic and religious organizations, and other nonprofit organizations the subordinate employees.
3. The anti-corruption behavior of public servants
8. Public servants need to resist corruption, prevent corruption offenses or offenses involving corruption or creating conditions for corruption.
Public servants need to stop corruption offenses from other government employees.
9. If a civil servant has reliable information about corruption offenses, he must take the necessary measures to prevent and stop such an offense.
The necessary measures include informing the authorized state bodies and informing superiors guide public body.
The direction of public body takes some actions accordingly after receiving information about corruption offenses, including for the protection of the civil servant, if his actions are no violations of law, from illegal persecution, adversely affect the subsequent official duties of a civil servant, his rights and legitimate interests.
10. Civil servants by their actions and decisions must avoid some administrative and other impediments to the implementation of individual and legal persons of their rights and legal interests. In the event of such facts, public servants should take steps to eliminate them.
11. Public servants need to use all the features to prevent economic damage to the state, to prevent the initiation of checks for personal interests and the interests of third persons.
12. Public employees should not use their official powers and the related opportunities for personal property and other benefits.
13. Public servants need to take some measures to prevent conflicts of interest.
14. When there is a conflict of interest, that is, a situation where there is a conflict between personal interests and public servant proper discharge of official duties, or the legitimate interests of individuals and businesses, the state, which can cause serious harm to these legitimate interests, the public official should take steps to its prevention and settlement under the laws of the Republic of Kazakhstan on public service.
4. Public Speaking
15. Public speaking on the activities of public authorities is carried out by his/her chief or by authorized officials of the state body.
Public servants need to hold discussions in the correct form, without undermining the authority of the civil service.
16. Civil servants should not express their views on public policy and service activity openly, if it is:
1) does not meet the basic directions of state policy;\
2) disclose proprietary information, which is not permitted to make public;
3) contains unethical statements to the officers of the state, government, and other public employees.
17. Publication is not allowed on behalf of the public authority on matters not related to the conduct of public policy, the activities of public authorities and public servants for public officials. Publication of materials on teaching, research and other creative activities can be public servants only on his/her own behalf as an individual.
18. When a public employee is charged with unreasonable public corruption, including involvement in business activities, lobbying for anyone's interests, as well as the illegal income and property income is not comparable to a public servant, he shall, within one month from the date of detection of such charges to measures for its refutation, including the courts..
5. Behavior of public servants off-duty
19. Public employees during off-duty time must keep generally accepted ethical standards, prevent cases of antisocial behavior.
20. Public servants need to be shy, do not stress and do not use the official position of public servants in receipt of transport, service and other services that do not give rise to legitimate criticism of his/her actions on the part of society.
