October 12, 2017 Astana. During the Coordinating Council on the Rule of Law, Order of Justice and Combating Crime (hereinafter - the Council) the General Prosecutor Office discussed measures of further optimization and digitization criminal and administrative processes.
As is known, on behalf of the Head of State the work on modernization of the criminal process is beind done in the country.
Opening the meeting, the Prosecutor General briefly focused on the advantages of pilot projects initiated by the General Prosecutor Office.
"People do not wait for months for a decisions on simple and obvious cases. The protection of human rights is increasing. The number complaints is fewer. The resources have been freed. Now investigators can focus on more important and complex cases. Our goal is fast, convenient and transparent process for people" Zhakip Asanov said.
More detailed information on the progress of the joint project with the Ministry of Internal Affairs on the optimization of the criminal process was reported by the Acting Director of the 1st General Prosecutor Office Ye.Abaev.
According to the Office, the project, first of all, allowed to shorten the terms of investigation of obvious crimes since the moment of their registration until the case was sent to court on average from 1-2 months to 3-10 days. This was achieved by eliminating unnecessary links in the coordination of decisions on the case, expanding the powers of the "duty prosecutor" and integrating the IT system of the General Prosecutor Office and the Ministry of Healthcare. So, for example, there was an opportunity for to get information from the drug and psycho-spillers during 2-3 minutes that used to take 2-3 days.
Now, "duty prosecutors" in the police department independently check the legality of registration of applications, delivery and detention of citizens, take citizens, explain to them laws.
After successful approbation of the project in the two police departments of Astana and Akmola Region, all regions of the country started working on a new format since July 1.
Today, over 8.3 thousand cases have been completed in the pilot project with referral to the court, 28% of which were investigated from 1 to 3 days, 43% up to 10 days.
As a result of a complaint to the General Prosecutor Office, the actions and decisions of the police decreased by 24% (from 34 thousand to 26 thousand), and illegal methods of investigation by 44% (from 3,351 to 1,484).
Further on, the Chairman of the General Prosecutor Office (CLSaSA) reported on the development of the digital state of the President's Message to Bagdat Musin.
He spoke about the advantages of the "E-criminal case" and the "Single register of administrative production" (hereinafter - SRAP) programs..
It was noted that the residents of the capital experienced a positive effect of the SRAP.
Here the electronic protocol is made in a few clicks in 5 minutes. After the input of the IIN, the necessary information is automatically centralized from all databases, the protocol is immediately registered in a single database. In this case, there is no possibility to rewrite, destroy or lose a case.
Time and money are saved, the process is as transparent as possible.
Since July of this year more than 5 thousand electronic protocols have been drawn up.
Execution of exaction is also automated. A notification of the penalty is sent to the infringer by a message to the phone. The penalty is allowed to pay on the spot.
Earlier, the procedure for registration of the protocol took at least 30 minutes, and registration did more than 10 days. The infringer paid a fine in the bank, and then carried a receipt to the state agency, the execution was completely out of control.
The integration with the IT-system of the Ministry of Justice of the AIS BEP allows the materials to be automatically sent for compulsory execution.
B.Mussin also reported on a number of problems that arose during the pilot approbation of the "E-criminal case" project in Astana and Zhambyl Region.
But, as the speaker assured, these problems are completely solvable with an integrated approach and support from local executive bodies.
Concluding the meeting, Zh. Assanov reminded the special attention is paid by the Head of State to the issues discussed and the solution of problems are in the interests of citizens.
Following the results of the Coordination Council, a number of decisions were taken to optimize and digitize the investigation of the criminal cases and administrative proceedings.
