II Forum on business protection held in General Prosecutor's Office  - 868243701

Astana. November 23, 2017 II Forum on business protection of business "Supervision of the Prosecutor's Office in the field of entrepreneurship" was held in the General Prosecutor's Office.

The co-organizers were the "Atameken" National Chamber of Entrepreneurs  (hereinafter - "Atameken" NCE) and the Republican Public Council on Support of Entrepreneurship under the Nur Otan party.

The Forum was attended by the deputies of the Parliament, the representatives of the President Administration, the Government, the central state bodies, the Ombudsman for the Protection of the Rights of Entrepreneurs, members of the Advisory Council.

Opening the event, the General Prosecutor Zhakip Assanov reminded the participants about the issues discussed at the previous Forum, the Road Map adopted on its results and outlined the issues that are necessary to resolve.

Welcoming the guests of the Forum, the Chairman of the Presidium of the "Atameken" NCE Timur Kulibayev thanked Zhakip Assanov for fruitful and constructive cooperation in resolving the systemic business problems.

More details about the results of joint efforts of the authorized bodies and the Atameken NCE, which significantly improved the "well-being" of the business, said Deputy Prosecutor General Marat Akhmetzhanov.

He noted that during one and a half years of the implementation of the Roadmap, the Rules for the registration of economic crimes which contributed to a significant reduction in cases of this category (if earlier in a month more than 800 cases on economic crimes were now wound up, now it does not exceed 200)have been amended, the humanization of criminal legislation was carried out, pseudo-entrepreneurship was decriminalized, a course to modernize the criminal process was taken.

Let’s recall that within the framework of the last initiative, the corresponding bill ("On Amendments and Additions to Some Legislative Acts of the Republic of Kazakhstan on the Modernization of the Procedural Basis of Law-Enforcement Activity") submitted to the Mazhilis by the Head of State was approved by the deputies on November 15 of this year.

The speaker dwelled on his most progressive innovations. This is a reduction in the terms of detention of citizens without the sanction of the court; the reduction of the grounds for applying the preventive punishment in the form of arrest for economic crimes; expansion of the powers of lawyers to submit appeals and collect evidence; the restriction of registration in URPI of materials without damage and certificates of checks and also on obvious civil-law disputes.

Another amendment which is designed to become a guarantee of protection of the rights of entrepreneurs in criminal proceedings is the norm which requires the investigator to conduct business only in the amount of the charge for which it was initially registered.

M. Akhmetzhanov also spoke about the audit of the control and supervisory functions of state bodies (30 out of 132 spheres of state control were excluded) reducing their unnecessary functions and requirements by 58% (from 30,497 to 12,843) systematizing the checks introducing their electronic registration developed by the "Camcor" mobile application, etc.

As a result, only through the SES and emergency situations, the verification requirements were reduced by 80% (from 14,800 to 2,500).

Also it became known about the planned changes in the administrative legislation towards humanization. Namely, the return to the Code of Administrative Offenses of the notion of "insignificance" the reduction in the amount of fines for 97 corpuses and the introduction of a warning on 23 articles, the possibility of their partial payment subject to agreement with the violation (the amendment will cover 607 personnel), etc.

At the end of the report, the Deputy Prosecutor General called on the Economic Investigation Service to toughen the fight against the "shadow business" and the “Atameken” NCE to render all the possible assistance in identifying unscrupulous entrepreneurs.

In his turn, a member of the Board of "Atameken" NCE Rustam Zhursunov shared the results of work and plans of the organization for the forthcoming period.

As a result of the discussion a new road map was approved.
