At the General Prosecutor’s Office discussed the questions regarding to compliance of constitutional rights of citizens at criminal justice process - 873896181

Today, at the extended meeting of the General Prosecutor’s Office the questions regarding to compliance of constitutional rights of citizens at the criminal justice process in 2018 and at the 1st decade of 2019 are considered.

Opening the ceremony, the General Prosecutor made an accent on actuality of defense of rights of citizens.

“The human rights are mostly limited in criminal justice process. Especially there they may arrest, search and may detain citizens. So that it is important that the criminal prosecution authorities doing their jobs should strictly obey the law,”- remarked G. Nurdauletov.

For the last half one year by prosecutors delayed 110 illegal conclusions about qualification of crime acts being made by suspected criminals, 82 out of them are serious crimes, rejected the  applications ask arrests of 549 citizens.

 615 citizens arrested illegally were released. The court acquitted more than 500 people.

Found the violations in process of investigation, and non correct use of criminal justice Law, inappropriate legal evaluation of circumstances.

Due to that by order of General Prosecutor all the criminal prosecution authorities paid attention on taking complex measures and actions on reconsidering the ways and methods of organization current task.

He remarked that anybody who goes to criminal prosecution authorities must be sure that their rights will be protected. Also Head of inspection service gave order to prosecutors to promote appropriate control and inspection on legal arrest, legal and appropriate setting of qualification and category to crime acts, and other procedural decisions of justice institutions. Pointing out the facts and cases of torture and unlawful methods of crime investigation, to law enforcement agencies recommended additionally to set up  CCTV -camera observation and interrogation rooms on administrative institutions, and to strengthen administrative control by taking cruel measures and actions to workers who restricts the rights of citizens. To Promotion of transparency of criminal process will also support digitalization of legal system which controlled by Committee of legal statistics and special records. After having meeting the members of session pointed out that the given task on modernization of criminal justice process is important and by their opinion, reformation support to improve the quality of justice, and to strengthen the principles of adversarial proceedings and also to raise the role and status of advocates.  In accordance to the results of meeting developed some concrete recommendations.
