About the International Conference on the modernization of criminal procedural law (March 3-5, 2016)

The International Conference "Modernization of procedural law as a guarantee of the efficiency of the justice and law enforcement activities” was held in Almaty region. The co-organizers were the Prosecutor General's Office, the Supreme Court and the Constitutional Council of the Republic of Kazakhstan, as well as the OSCE Programme Office in Astana, the Council of Europe Venice Commission, the German Foundation for International Legal Cooperation «IRZ» and other international organizations.

The forum was attended by Assistant to President - Secretary of the Security Council of Kazakhstan Mr. Nurlan Yermekbayev, Chairman of the Constitutional Council Mr. Igor Rogov, Chairman of the Supreme Court Mr. Kairat Mami, Prosecutor General Mr. Askhat Daulbayev, Minister of Justice Mr. Berik Imashev, as well as the representatives of international, non-governmental, social organizations and scientific community from Germany, Russia, the USA, Ukraine.

Prosecutor General Mr. Askhat Daulbayev launched the second day of the conference dedicated to the issues of the new model of criminal procedure legislation. He emphasized the importance of reforming the criminal procedural law and the introduction of innovative procedural mechanisms of ensuring human rights for the purposes of implementation the tasks allotted  by the Head of State on establishment of law enforcement system that meets public expectations and the highest international standards.

The main topics of the agenda were the issues related to the introduction of the modern model of pre-trial investigation, enhancement of the quality of prosecution, strengthening the role of prosecutors and the court in criminal proceedings.

The conference participants noted that the practice had confirmed the correctness of the initiated reforms. In the context of the renewed criminal procedure legislation the new legal and procedural institutions are operating successfully, which made it possible to significantly reduce the caseloads on the investigative authorities and the courts, to ensuring the guarantees of the rights and interests of proceeding participants.

First Deputy Prosecutor General Mr. Iogan Merkel highlighted the results of the analysis of practical application of the new Criminal and Criminal Procedure Codes, noted the undeniable advantages of the new model of pre-trial proceedings, innovative mechanisms of protection of citizens rights. He underlined that on the basis thereof the further development of the criminal process should be aimed primarily at strengthening public confidence, enhancing the image of Kazakhstan in the international arena.

During the forum there were active discussions and exchange of views on the major novels of pre-trial proceedings, law enforcement practice in the frame of Criminal Procedure Code. The speakers noted the importance of the reforms, and made a number of proposals aimed at further improvement of the criminal process.

Guests from the CIS and European countries shared their work experience in pre-trial investigation. Foreign experts appreciated the introduction to the national legislation of norms guided by international standards.

Joint discussions on procedural innovations allowed to objectively analyze the results of law enforcement practice, to determine the main directions of further improving of the procedural legislation, optimization of pre-trial proceedings, strengthening its human rights capacity.
